1. ORDER

1.1 PLACING THE ORDER

By making a purchase on Lightosphere, you agree to have read, understood and accepted all the terms and conditions outlined in this website.

All prices listed are in Australian Dollars (AUD) and are inclusive of GST.

All shipping and handling charges (if any) associated with the sale will be specified along with the price of the products at Checkout. Please take note of special offers and discounts on shipping and handling available from time to time.

It is the responsibility of the customer to ensure accuracy of the information provided while completing the order. All costs resulting from errors made by the customer while supplying delivery information such as shipping address, contact number, etc will be borne by the customer.

 

1.2 PAYMENT METHODS

You can pay by Bank Transfer, Visa, MasterCard or PayPal as well as redeem a valid coupon code or gift voucher supplied by Lightosphere.

All credit card payments are securely processed through National Australia Bank (NAB) payment gateway. NAB manages all card data entered by customers. You can be assured that the information you enter is directly accessed by NAB and is not visible to Lightosphere for security reasons. This means no credit card data will enter our web server and we will not have any of your card details on our records.

When you pay through Bank Transfer (direct deposit), there is no surcharge. Our bank account details will be displayed at checkout when you select Bank Transfer as your payment method. Please enter your order number as payment reference.

Visa or MasterCard payments incur a 1.5% surcharge.

PayPal payments incur a 2.6% surcharge.

Refunds are processed through a Bank Transfer. In case we need to transfer funds back to you, the amount will be paid into the bank account provided by you. Any surcharge or shipping costs incurred by Lightosphere will not be refunded.

 

1.3 SECURE PAYMENT

Online safety and security of customer information are of utmost importance to us. All sensitive information is securely encoded using Secure Sockets Layer (SSL) technology to ensure protection of data over Internet.

In case we need to verify the payment, we will be contacting you.

 

1.4 CONFIRMATION AND ACCEPTANCE

Orders placed are subject to confirmation and acceptance by Lightosphere.

Lightosphere reserves the right to refuse or cancel any order regardless of the payment status. This will be notified to the customer at the earliest and a refund will be processed promptly in case payment has been made. Any variations or amendments to the order will also be communicated in a timely manner.

Although every effort is taken to ensure accuracy of information available on Lightosphere, Lightosphere reserves the right to cancel any orders, revoke offers and correct any errors, omissions or ambiguous information at any point in time. Please note that prices, charges and product availability are subject to change without notice.

 

1.5 ORDER CONFIRMATION

You will receive an email confirmation from us once the order is placed. If there are any issues or we require additional information, we will get in touch with you.

After placing the order, if you happen to notice any changes or errors, please notify us immediately at sales@lightosphere.com.au.

Orders will be processed once cleared funds are received into our bank account. If payment is not received within 3 days, you will be notified via email. Your order may be subject to cancellation if you do not respond within 3 days from receipt of our email.

 

1.6 AVAILABILITY

Every effort is taken to ensure the availability status listed on the website accurately reflects our stock levels. However, in the unlikely event where an error has been made on our part, we will notify you as soon as possible. You can opt for your item to be placed on backorder or get a full refund for the item that is not available.

All refunds will be processed through bank transfer. Therefore, it is essential that you provide your bank details for us to process the refund in such situations.

 

1.7 PRODUCT IMAGES AND DESCRIPTIONS      

The images provided for each product are for illustrative purposes only.

Although care is taken to ensure the actual product is used for photos and the specification and product details accurately reflect the actual item, unintentional errors may occur.

There could be occasions where a larger or smaller size product may be displayed. Please refer to the product specification for accurate details.

Computer screen resolutions may lead to variations in colour shades. The angle of the photos and camera techniques used may cause minor differences in the images when compared to the actual products.

We reserve the right to modify the price of an item at any time without notice. We are in no obligation to provide a discount or refund if the price of an item is modified after the order is placed.

1.8 LIMITED TIME OFFERS

Lightosphere runs promotional offers from time to time. These offers are generally available only for a limited period.

Lightosphere reserves the right to revoke any of these offers at any time without notice. The offer periods specified are for indicative purposes only.

The offers are introduced to encourage customers to purchase products and increase their savings. Any abuse, exploitation or unfair means exercised will be constantly monitored. In such cases, the offers may not be made available and full purchase prices may apply. This will be at the sole discretion of Lightosphere and the final decision made by Lightosphere will be final and binding.


 

2. SHIPPING

2.1 DOMESTIC DELIVERY

We ship to anywhere in Australia. It is essential you provide a physical address as the delivery address. Please note we do not deliver to PO box addresses or parcel lockers owing to the dimensions of the items.

If the address is incorrect or does not satisfy the above criteria, you will be liable to pay redelivery charges.

 

2.2 INTERNATIONAL DELIVERY

Requests for delivery to addresses outside Australia will be considered on a case by case basis.

Please contact us at sales@lightosphere.com.au if you are located outside Australia and would like to purchase an item from our store. We can provide you with an estimate on shipping costs and delivery timeframes.


2.3 DESPATCH

Once cleared funds are received into our bank account, we will endeavour to despatch the goods within 1-2 business days. This can vary depending on the volume of orders received.

Every item is thoroughly inspected prior to shipping in order to ensure there are no surprises as much as possible after you receive the goods.

You will receive an email as soon as the items are shipped.

If you require urgent delivery, please contact us at sales@lightosphere.com.au so we can help achieve earliest possible despatch and delivery timeframes to meet your needs.

  

2.4 DELIVERY METHOD

All orders will be shipped from Inner-west Sydney, NSW and will be delivered through courier.

Our aim is to deliver your goods at the lowest possible shipping charges and within minimum timeframes. Therefore, we partner with various reputed courier service providers such as Australia Post, Couriers Please, TNT, Fastway Parcel, Toll, Allied Road Express, etc as well as many other shipping solution providers that work with these courier companies.

Any requests for pick-up will be handled on a case-by-case basis. Please contact us at sales@lightosphere.com.au prior to placing the order in case you wish to pick up your items.

If Lightosphere agrees for you to pick up your item, you will be notified once the order is ready for pick-up. This is to ensure there are no delays or wait involved as much as possible when you arrive at the pick-up location.


2.5 SHIPPING COST

Lightosphere endeavours to offer FREE shipping to customers as much as possible. This covers most metro and regional areas.

We are proud to offer discounted shipping to all other areas.

Shipping charges are based on the destination postcode as well as the dimensions and weight of the carton.

You can check the shipping cost estimate for an individual item on its product page by using the ‘Shipping Calculator’ below the ‘Add to Cart’ button.

Purchase of more than one item qualifies for further discounts in shipping.

You can check the total discounted shipping charges for your order using the ‘Estimate Shipping & Taxes’ section on the ‘’Shopping Cart’ or ‘Checkout’ page.

Very few items that are much heavier and bulkier than normal tend to have large variations in shipping charges depending on the destination suburb. These items may not display shipping cost in the Product page Shipping Calculator or Shopping Cart page. Please contact us and provide the item model number, quantity, your suburb and postcode so we can provide you with accurate shipping costs.


2.6 TRANSIT INSURANCE

We offer complimentary insurance on all deliveries to cover unlikely event of loss or damage during transit. The insurance covers for either partial or full value of the order depending on the courier service provider. The insurance cover requires claims to be made immediately. Therefore, it is essential that you check the items and report any issues to us at sales@lightosphere.com.au within 3 days from receipt of the items. Any issues reported after this timeframe will not be considered for free of charge replacement.


2.7 DELIVERY TIME

All items are shipped from Sydney, NSW. The delivery times are dependent on your location. Here are indicative timeframes for delivery after despatch of the items.

Hint: Timeframes are likely to lie in the lower end of the range for urban areas and upper end for remote areas.

Due to the nature of the logistics industry, we cannot guarantee delivery within certain timeframes or specific times during the day. We assume no liability for delays in delivery and this does not provide rights for returns or refund.

 

2.8 TRACKING

All items shipped have an online tracking feature. As soon as the order is shipped, we will communicate the tracking details such as the service provider, tracking number, tracking url, shipping solution provider and estimated delivery time as well as redelivery options.

 

2.9 DELIVERY OPTIONS

By default, all deliveries require signature upon receipt of the items. Therefore, we recommend that you provide an address where someone will be present during business hours to sign for delivery.

If there is no one available when delivery is attempted, a card is left at the address with instructions on how to organise redelivery or pick-up from courier depot if applicable. Some courier companies offer redelivery free of charge while others charge a fee. Any costs associated with redelivery will be borne by you and this will be informed as soon as the item is shipped. If the goods are not claimed and are returned to us, we will contact you to re-send the items at additional costs.

If you think you will not be available when delivery is attempted and it is safe to leave the items unattended at the destination location, please mention this at the time of placing the order. You can do so by providing your permission for ‘ATL – Authority To Leave’ in the comments box at checkout so we can inform the courier service provider to drop-off the item without obtaining a signature.

Lightosphere does not take any responsibility for lost, stolen or misplaced goods in instances where customer has granted permission for leaving the items without signature as this is not our preferred delivery option. The customer bears complete responsibility for any issues and costs in such situations.

 

2.10 REMOTE LOCATIONS

If you are located in a remote area and prefer collecting your items from an authorized courier pick-up point or depot in a nearby town that you are familiar with, please nominate that as your delivery address and enter your instructions in the comments box at checkout so we can inform the courier service provider.

 

 

3. RETURNS

3.1 DAMAGED ITEM

Every item and every part is thoroughly inspected prior to despatch. All our items come with superior packing materials. Every care is taken to ensure individual parts are securely wrapped and are damage-proof during travel. We take these measures to provide quality service.

Please check the items thoroughly for any damage as soon as you receive them and prior to installation. Ensure great care while taking out fragile parts from the carton box and removing the packaging.

Please note the following:

  • Kindly report any breakage or damage to the items within 3 days from receipt of the items to sales@lightosphere.com.au. Insurance cover requires claims to be made immediately and hence any issues reported after this timeframe will not be considered for free of charge replacement.
  • You will be eligible for a free of charge replacement of the damaged item or damaged parts as the case may be. This does not constitute a refund. If the item is not in stock, a store voucher (redeemable at Lightosphere) for the order value will be provided.
  • When you report breakage or damages, you will be required to explain the issue and provide photos to substantiate the situation for claims purposes.
  • You may be required to provide a copy of the order confirmation or invoice as proof of purchase.
  • In certain situations, you may be requested to send the item back to us at our expense for us to validate and process the claim.
  • You will be subject to pay $50 admin fee if the claim was misrepresented.
  • Any physical damage, abuse, misuse, unauthorised repair or tampering of parts will make your claim invalid.
  • If the item is considered not to be damaged, we are in no obligation to provide you a free of charge replacement. You will be charged misrepresentation fees listed above plus shipping fees for sending the item back to you.

Please allow 3 days for us to process your claim and provide a response.

The shipping method adopted for sending you the replacement item or parts will be same as the original order shipping. Please contact us in case you need your item urgently though express service. You will be charged additional costs.

 

3.2 FAULTY ITEM

Every item goes through proper testing prior to acceptance. We also offer a 12 month warranty on all our light fixtures.

Please report any faulty items to sales@lightosphere.com.au within 14 days from the date of delivery.

A claim in relation to a faulty item is valid only if the following conditions are met.

  • An item is considered to be faulty if it is not fully functional or shows signs of failure when installed within 14 days from the date of delivery.
  • The installation must have been carried out by a licensed electrician for the claim to be valid.
  • Any installation instructions supplied along with the item must have been properly followed step by step.
  • When you report a faulty item, you will be required to explain the issue and provide a copy of the invoice supplied by the electrician and photos to substantiate the situation.
  • You may be required to provide a copy of the order confirmation or invoice as proof of purchase.
  • In certain situations, you may be requested to send the item back to us at our expense for us to validate and process the claim.
  • You will be subject to pay $50 admin fee as well as return shipping charges incurred by us if the claim was misrepresented.
  • Any physical damage, abuse, misuse, unauthorised repair or tampering of parts will make your claim invalid.

If an item is deemed faulty as per above criteria and is reported within 14 days from the date of delivery to sales@lightosphere.com.au, you will be eligible for a free of charge replacement of the faulty item or faulty parts as the case may be. This does not constitute a refund. Any issues reported after this timeframe will not be considered for free of charge replacement. If the item is not in stock, a store voucher (redeemable at Lightosphere) for the order value will be provided.

Unfortunately, we will not be able to credit you for any expenses incurred during installation of the item. We will replace the faulty item free of charge.

If the item is considered not to be faulty, we are in no obligation to provide you a free of charge replacement. You will be charged misrepresentation fees listed above plus shipping fees for sending the item back to you.

If a light bulb is reported to be faulty within 14 days from the date of delivery, we will send you replacement bulbs free of charge.

Please allow 3 days for us to process your claim and provide a response.

The shipping method adopted for sending you the replacement item will be same as the original order shipping. Please contact us in case you need your item urgently though express service. You will be charged additional costs.

 

3.3 CHANGE OF MIND

For any reason, if you change your mind after the order is placed, please contact us at sales@lightosphere.com.au within 7 days from the date of order.

If you have purchased an item in error, please contact us at sales@lightosphere.com.au immediately. The change of mind conditions listed below will apply.

A return is acceptable only if the following conditions are met.

  • The item is in original condition, unopened, unused, not installed and is fully resalable when we receive it.
  • The request is received by us within 7 days from the date of order.
  • The item is shipped back to us only after we ask you to do so.
  • Once we process your request and ask you to send the item back to us, you must ship the item within 7 days from the date of our reply email.
  • The items must be returned in their original carton boxes and packing materials with all individual parts included.
  • You may be required to provide a copy of the order confirmation or invoice as proof of purchase.
  • The items must be returned through a reputed courier service with online tracking feature and signature on delivery.
  • You are responsible for return shipping charges.
  • Bulbs (globes) are not eligible for change of mind returns.
  • The item listed does not state that the item cannot be returned.
  • Custom orders where an item has been specifically designed to meet your specifications are not eligible for cancellation or return.

You will receive a store voucher (redeemable at Lightosphere) for the order value minus onward shipping charges (includes free shipping items). We also reserve the right to charge a 10% restocking fee. Change of mind does not constitute a refund.

If the items had not been despatched when we process your request, you will not be subject to pay for shipping charges.

If we do not receive the items back or we find out that any of the above conditions have not been fully met, then the return cannot be processed. We highly recommend that you opt for courier insurance for the complete value of the items. We bear no responsibility for any loss or damage during return shipment. We are in no obligation to provide a store voucher if the return conditions are not fully met. Additional charges may be deducted to cover any loss due to transit damage. In case of any disputes, the decision made by Lightosphere will be final and binding.

Please allow 7 days for us to process your change of mind request and provide a response. It may take up to 14 days for us to inspect the returned item and provide a response on whether the item meets our returns policy.


 

4. WARRANTY

All light fixtures come with a 12 month warranty.

If a light bulb is reported to be faulty within 14 days from the date of delivery, we will send you replacement bulbs free of charge.

The warranty period starts from the date of purchase. It is a requirement by law in Australia that all hard-wired electrical items are installed by a licensed electrician.

A warranty claim is valid only if the following conditions are met.

  • The claim is made during the warranty period.
  • All electrical work including installation of the item must have been carried out by a licensed electrician for the claim to be valid.
  • Any installation instructions supplied along with the item were properly followed step by step.
  • You will be required to provide a copy of the order confirmation or invoice as proof of purchase.
  • You will be required to explain the issue and provide a copy of the invoice supplied by the electrician at the time of installation.
  • Any physical damage, abuse, misuse, unauthorised repair or tampering of parts will make your claim invalid.
  • Warranty does not cover the incorrect installation, damage through incorrect use or power fluctuations or normal wear and tear.
  • Bulbs (globes) are not eligible for warranty claims.
  • The item is not stated as not covered under warranty.
  • Warranty is not transferrable.
  • Any costs associated with a claim are to be borne by you.

If the claim is considered to be valid, you will be eligible for a free of charge replacement of the non-functional item or parts as the case may be. A warranty claim does not constitute a refund. If the item is not in stock, a store voucher (redeemable at Lightosphere) for the order value will be provided.

In certain situations, you may be requested to send the item back to us at our expense for us to validate and process the claim. You will be subject to pay $50 admin fee as well as return shipping charges incurred by us if the claim was misrepresented.

Please allow 7 days for us to process your claim and provide a response. It may take up to 14 days for us to inspect the returned item and provide a response on whether the item meets our warranty conditions.

The shipping method adopted for sending you the replacement item will be same as the original order shipping. Please contact us in case you need your item urgently though express service. You will be charged additional costs.



5. PRIVACY POLICY

Lightosphere is committed to ensuring customer details are treated with highest level of care and security. We will collect, use and disclose and hold personal information in accordance with the Privacy Act 1998 ("the Act").

We only collect information by lawful and fair means and in an unobtrusive way. You can provide information to us through online forms, social media, email or phone. This information will only be utilised to provide services to you.

The information we collect will only be shared with parties that are involved in processing your order. Only relevant information that is absolutely necessary for processing the order will be shared with these parties.

We will not share any of your information with third parties without your consent. Your information will be kept purely confidential.

The information collected will be solely used to process your order and to personalise your shopping experience at our store. Certain features of our website may require cookies to be enabled at the user end. These cookies are used purely to keep track of your updates to the shopping cart and store your details during the browsing session.

At any point in time, upon request, we can let you know what information we collect, why we collect, how it is stored and whom it was shared with (solely for the purpose of processing your order), the consequences if you do not disclose the required information and how to make corrections to the stored information.

The information you provide may be occasionally used for marketing purposes to promote our products and special offers. You will always have the option to unsubscribe or write to us at sales@lightosphere.com.au in case you do not wish to receive any marketing communication from us.

If you happen to be selected as eligible for any special offers or happen to be the winner of any promotional contests or schemes introduced from time to time, we may decide to publish your details such as name, location, products bought, testimonials, reviews, feedback, product photos received from you on our website, social media or other marketing materials. Your contact details will never be shared with anyone. You can write to us at sales@lightosphere.com.au any time if you want us to remove any of your information published online or remove any information from future prints of marketing materials.

You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the Website, or the use by any other person accessing the Website using your PC or internet access account.

The Website is provided on an "as is" and "as available" basis without any representation or endorsement. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation save insofar as the same has expressly been made a representation in these Conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions save that your agreement contained in this Clause shall not apply in respect of any fraudulent misrepresentation whether or not such has become a term of these Conditions.



7. LIABILITY LIMITATIONS

To the extent permitted by law, Lightosphere

  • limits its obligations and liability for the repair, replacement or refund of the purchase price of any goods to its obligations under the Act;
  • is not liable for any contingent, consequential or punitive damages arising in way whatsoever including but not limited to the use of any goods, loss of profit, business, revenue, goodwill or anticipated savings;
  • does not accept any liability whatsoever for the goods ordered and/or any loss or damage incurred by any person in relation to your order once it has been received by the courier for delivery to you; and
  • is not liable for any claim, loss or expense incurred by any person resulting from the delivery, non-delivery or return of any goods.



8. APPLICABLE LAWS

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. If any provision of these Terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of these Terms, which will continue in full force and effect. If you access this website in a jurisdiction other than New South Wales, Australia, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply.
